Item 8.01 Other Events.

As previously disclosed, on September 17, 2018, ChromaDex Corporation (the “Company”) and Trustees of Dartmouth College filed a patent infringement complaint in the United States District Court for the District of Delaware against Elysium Health, Inc. The Company licenses U.S. Patent No. 8,383,086 and U.S. Patent No. 8,197,807 from the Trustees of Dartmouth College, which give ChromaDex exclusive rights to the leading NAD precursor nicotinamide riboside (NR). The court previously set a jury trial to begin on September 27, 2021.

On September 14, 2021, the court granted a Motion for Summary Judgment and vacated the trial date. The Company plans to appeal the court’s decision.
