On April 19, 2021, the arbitrator in the previously disclosed arbitration between VirnetX Holding Corporation and McKool Smith, P.C, (“McKool”), McKool
Smith P.C. v. VirnetX, Inc., AAA Case No. 01-20-0003-7975, awarded McKool $36,322,708.79 in damages, plus pre-judgment interest in the amount of 5% simple interest from March 23, 2021 to April 18, 2021, and post-judgment interest in the amount of
5%, compounded annually, until payment of the award.
